By accessing or using the KitnBit website, API, and associated tools (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

KitnBit provides a suite of local-first utility tools, primarily running via WebAssembly in your browser, alongside API services for developers. While we strive to maintain 99.9% uptime, the Service is subject to continuous development and may be modified, updated, or temporarily suspended without prior notice.

3. User Accounts and Security

To access certain features, you must register for an account using Google OAuth or email authentication. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. KitnBit reserves the right to suspend or terminate accounts that violate our policies or pose a security risk to the platform.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Upload, process, or distribute illegal, infringing, or malicious content.
  • Attempt to reverse-engineer, decompile, or exploit our WebAssembly modules, server architecture, or APIs.
  • Engage in automated scraping or abusive requests that degrade the performance of the Service for other users.
  • Bypass rate limits, paywalls, or authentication mechanisms.

5. API Usage, Quotas, and Billing

Use of the KitnBit Developer APIs is subject to the rate limits and pricing tiers published on our Pricing page. You agree to pay all applicable fees associated with your API usage. We reserve the right to throttle or block API requests that exceed permitted quotas or represent abusive traffic patterns. Refunds are provided solely at the discretion of KitnBit management.

6. Intellectual Property

Your Data: KitnBit claims no ownership rights over the files, text, images, or data you process using our tools. Because our primary tools are "zero-upload" and run locally in your browser, your data remains exclusively yours.

Our Service: The KitnBit platform, including its codebase, UI/UX design, trademarks, WebAssembly binaries, and documentation, are the exclusive property of KitnBit. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KITNBIT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

IN NO EVENT SHALL KITNBIT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Nairobi, Kenya.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service following such updates constitutes your acceptance of the revised Terms.
